Legal Adviser
The ICRC Regional Delegation for East Asia covers China, DPRK, South Korea, and Mongolia. The delegation’s main task is to promote awareness and implementation of international humanitarian law, the legal framework that seeks to minimize human suffering caused by war. The delegation also aims to familiarize governments, experts, national Red Cross societies and civil society with the ICRC’s humanitarian work and emergency response around the world.
Under the supervision of the Head of Legal Department of the Regional Delegation for East Asia, the Legal Adviser supports the ICRC and Delegation's objectives aimed at promoting and implementing international humanitarian law (IHL) and other relevant legal norms in national domestic law and facilitates the delegation's activities related to the dissemination and development of IHL in China. He/she monitors the integration of IHL norms in domestic law and the development of domestic law in areas within the scope of ICRC's mandate and activities and facilitates contacts and relations with national authorities at the technical level, as well as with legal experts from other relevant national organizations and institutions.
ACCOUNTABILITIES AND RESPONSIBILITIES (as per role description)
· Organizes meetings, gatherings or conferences under the direction of the Head of Legal Department, applying relevant administrative and logistics procedures.
· Follows up and keeps track of programme & activity development, and budget expenditure.
· Provides translation, takes notes during meetings and conferences, and drafts reports and Minutes of Meetings based on them.
· Analyses the situation, advises and provides guidance on the applicable national and international legal frameworks and norms in relation to the Regional Delegation’s activities, objectives, strategies and plans of action to address identified legal and other related issues.
· Drafts legal notes/analyses and contributes with legal aspects to working papers, summary
reports, ’non-papers' etc. related to the Regional Delegation’s activities and objectives.
· Participates in the development and implementation of institutional strategies for IHL promotion, implementation, and development in RoK.
· Performs independent research on and analysis of specific legal issues, as well as broader sectors of the national legal system.
· Supports IHL dissemination activities directed at specialized audiences and the public at large and supports the implementation of strategies, programmes and action plans related to IHL treaty participation, the development of relevant domestic legal and policy frameworks and mechanisms for their implementation.
· Supports the provision of legal advice and technical assistance to national authorities and other interested parties.
· Monitors developments in the national implementation of IHL and relevant international human rights law (IHRL) norms.
· Maintains relations with academic circles, supports the teaching of IHL and develops and maintains a network of partners and contacts linked to legal questions and IHL promotion and implementation.
· Seeks partnership opportunities that will promote IHL work in China.
· Represents the Regional Delegation in meetings with external contacts; participates in dissemination sessions if required.
· Advises on socio-political and legal aspects related to the regional delegation’s strategy and
operations.
· Represent ICRC on IHL related engagements.
· Promote the ratification, implementation, and dissemination of IHL related treaties.
· Contribute to the update of the Customary IHL Study.
· Strengthen and develop the network of actors of influence for the promotion and integration of IHL within relevant entities and actors of influence.
· Provides support to the National Society and the International Academy of the Red Cross on legal matters.
· Coordinates and supervises external consultancies on legal issues.
· Creates and maintains a network of contacts with think tanks and research institutions specializing in law, policy and humanitarian affairs.
· Keeps abreast of the development of IHL at domestic, regional and global level.
· Keeps abreast of ICRC’s legal positions, publications, and other relevant material.
· Drafts legal opinions/paper on operational legal issues.
· Supports the work on techplomacy on cyber related issues.
· Supports other department in achieving the Regional Delegation’s objectives and priorities.
· Bachelor’s degree in law; Preferably Master’s degree in law, with a focus on international law, including, preferably, International Humanitarian Law.
· Very good knowledge of international law preferably in the humanitarian field, and of Chinese domestic law (must have completed part of the legal education in China).
· 1-2 years’ experience in working with government bodies, armed forces, academic institutions, or organizations dealing with international law issues, including, preferably, International Humanitarian Law issues.
· Fluent command of English (written and spoken).
· Computer proficiency.
· Demonstrated ability to connect with and relate to people of diverse background.
· Good networking skills to establish contacts with public authorities.
· Excellent presentation skills and at ease with public speaking.
